Mac ID Terms of Use

1. Agreeing to these terms

These Terms of Use ("terms") are a binding agreement between you and us. You accept them when you tick "I agree" in the app or on our website, or when you download, install, buy, activate or use Mac ID, whichever happens first. If you don't agree, don't download, buy, install or use Mac ID.

If you accept these terms for a company or other organisation, you confirm you have authority to bind it, and "you" includes that organisation.

2. Who can use Mac ID

You must be at least 18, or the age of legal majority where you live if that is higher. If you are younger, a parent or legal guardian must read and accept these terms for you, and is responsible for your use of Mac ID.

You may not use Mac ID if the law where you live forbids it, or if we have previously ended your licence.

3. Who we are

Mac ID ("Mac ID", "we", "us", "our") is independent software made and sold by Sammy Mittman. Payments are handled by Lemon Squeezy, which acts as the merchant of record for every purchase. Mac ID is not made, endorsed, sponsored or supported by Apple Inc. "Mac", "macOS", "Face ID" and "Touch ID" are trademarks of Apple Inc. You can reach us at [email protected].

4. Your licence

Subject to these terms, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use Mac ID on one Mac that you own or control, for your own personal or internal business use.

6. What Mac ID is, and its limits

Mac ID is a convenience feature. It recognises a face with your Mac's camera and, when it does, types your stored macOS password to unlock your Mac. It is not a security product, and it is not a substitute for your password, FileVault, Touch ID or any other security measure. You understand and agree that:

8. You use Mac ID at your own risk

You understand the limits described in section 6 and you voluntarily accept all risks of downloading, installing and using Mac ID, including the risk that someone other than you, or an image of you, unlocks your Mac. You agree that you are solely responsible for any consequences of those risks.

9. Unauthorised access, loss and damage

We are not responsible or liable for any access to, or use of, your Mac, your accounts, your data or anything else by anyone without your permission, however it happens. This includes access that happens because Mac ID was fooled, misused, bypassed or disabled; recognised someone other than you; unlocked when you did not intend it; failed to lock or unlock; malfunctioned; or had a bug or vulnerability. It also includes anything that follows from that access, such as loss, theft, deletion, disclosure or misuse of information, identity theft, fraud, financial loss, damage to your Mac or other property, harm to your reputation, or emotional distress.

The price, taxes and currency are shown at checkout. Lemon Squeezy processes every payment as merchant of record, issues your receipt and invoice, and its terms apply to the purchase. Each purchase is a one-time payment for one licence. We may grant refunds at our discretion, and will give any refund the law requires. We may deactivate a licence that has been refunded, disputed or charged back, or that was bought fraudulently.

12. Updates, changes and availability

Mac ID checks for updates daily and may install them. We may add, change or remove features at any time, and we are not obliged to provide any update, upgrade, fix or new version. We may discontinue Mac ID at any time. Activation, trials and licence emails rely on online services that may be interrupted or stop; we are not liable if they are unavailable.

We provide support by email on a best-effort basis. We don't promise to answer within any time, or to fix any particular problem.

14. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, MAC ID, OUR WEBSITE AND EVERYTHING WE PROVIDE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT AND SECURITY, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT MAC ID WILL RECOGNISE YOU, REFUSE ANYONE ELSE, KEEP YOUR MAC OR DATA SECURE, WORK WITHOUT INTERRUPTION OR ERROR, BE FREE OF VULNERABILITIES OR HARMFUL COMPONENTS, OR WORK WITH ANY PARTICULAR MAC OR VERSION OF MACOS. NO ADVICE OR INFORMATION FROM US, ON OUR WEBSITE OR ELSEWHERE, CREATES ANY WARRANTY.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PRIVACY, PROFITS, REVENUE, BUSINESS OR GOODWILL, ANY UNAUTHORISED ACCESS TO OR USE OF YOUR MAC, ACCOUNTS OR DATA, ANY IDENTITY THEFT OR FRAUD, ANY DAMAGE TO PROPERTY, ANY PERSONAL INJURY OR EMOTIONAL DISTRESS, OR THE COST OF SUBSTITUTE PRODUCTS, ARISING OUT OF OR RELATING TO MAC ID OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO MAC ID OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR MAC ID IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US$5.

THESE LIMITS APPLY WHATEVER THE LEGAL THEORY, WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR ANYTHING ELSE, EVEN IF WE WERE TOLD SUCH DAMAGE WAS POSSIBLE, AND EVEN IF A REMEDY IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE. THEY ARE AN ESSENTIAL PART OF THE BARGAIN: WITHOUT THEM WE WOULD NOT OFFER MAC ID AT THIS PRICE.

16. You will cover claims caused by your use

To the fullest extent permitted by law, you will defend, indemnify and hold harmless us and anyone acting for us from and against every claim, demand, loss, liability, damage, cost and expense (including reasonable legal fees) arising out of or relating to: your use or misuse of Mac ID; anyone you enrolled or allowed to use your Mac; your breach of these terms; or your breach of any law or anyone else's rights. We may take over the defence of any such claim, and you will cooperate with us.

17. Release

To the fullest extent permitted by law, you release us from all claims, known and unknown, arising out of or relating to anyone else's access to or use of your Mac, your accounts or your data. If you live in California, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law where you live.

19. Governing law

These terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

20. Ending these terms

Your licence ends automatically if you break these terms. We may also suspend or end it, or deactivate your key, if we reasonably believe you broke these terms or acted fraudulently. You may end these terms at any time by deleting Mac ID and its data. When they end, you must stop using Mac ID and delete it. Sections 6 to 10 and 14 to 23 continue to apply after these terms end.

21. Changes to these terms

We may change these terms. The current version is always on our website, and when a change is significant Mac ID will ask you to accept the new version before you can keep using it. If you don't accept a new version, stop using Mac ID.

22. Your rights under consumer law

Some places don't allow some of the exclusions and limits in these terms, or give consumers rights that can't be removed by contract. Nothing in these terms limits any right you have that the law says can't be limited, and nothing excludes liability that the law says can't be excluded, such as liability for fraud, or for death or personal injury caused by negligence where that can't be excluded. In those places our liability is limited to the smallest amount the law allows.

23. General

These terms are the entire agreement between you and us about Mac ID and replace anything said or written before. If any part is found unenforceable, it is changed to the minimum extent needed, and the rest stays in force. If we don't enforce a right, we haven't given it up. You may not transfer these terms or your licence; we may transfer them, for example if Mac ID is sold. We are not liable for any delay or failure caused by events outside our reasonable control. You must follow all export and sanctions laws that apply to Mac ID. You agree that we may communicate with you electronically, and that accepting these terms electronically is as binding as signing them. These terms are written in English, and the English version controls.
